Terms of Service

Welcome to Selliya. These Terms of Service ("Terms") govern your access to and use of the Selliya website (selliya.com) and related pages (the "Site") and any creative services offered by Selliya (the "Services"), including AI-generated videos, brand stories, brand ambassadors, fashion and product content, founder stories, and social media management.

If you do not agree to these Terms, do not use the Site. If you purchase Services, these Terms apply in addition to any proposal, statement of work, order form, or service agreement you enter into for the Services (each, a "Service Agreement"). If there is a conflict, the Service Agreement controls for that project.

1. Eligibility and Permitted Use

You must be at least 18 years old (or the age of majority where you live) and able to form a legally binding contract to use the Site or purchase Services.

You may use the Site only for lawful purposes. You agree not to: violate any applicable laws or regulations; infringe the intellectual property, privacy, publicity, or other rights of Selliya or any third party; attempt to gain unauthorized access to systems or networks connected to the Site; introduce malware, exploit vulnerabilities, or interfere with the Site; or use the Services to create or distribute deceptive, fraudulent, or harmful content, including deepfakes or synthetic media without explicit consent of the relevant individuals.

2. Inquiries, Estimates, and Project Booking

Any timelines, pricing ranges, or estimates shown on the Site or provided during initial conversations are for informational purposes only and are not binding unless included in a signed Service Agreement. We do not begin production work until the parties agree in writing on scope, fees, deliverables, timeline, and any required deposits.

3. Client Responsibilities

You are responsible for ensuring that all materials, instructions, and approvals you provide are accurate and lawful. You represent and warrant that you own or have all necessary rights, permissions, licenses, and releases for any materials you provide to us (including logos, music, footage, images, scripts, trademarks, and personal data) and for any individuals featured in your project as required by law.

4. Fees, Deposits, and Payments

Fees are set out in the Service Agreement or as listed on the Site at the time of purchase. Unless otherwise stated: deposits are non-refundable once production resources are scheduled or work begins; late payments may pause work and delivery; and you are responsible for any applicable taxes, duties, or similar governmental charges.

5. Revisions, Reviews, and Approvals

Revision rounds, review periods, and approval milestones are described in the Service Agreement or the applicable pricing tier on the Site. Delays in feedback or approvals may impact delivery dates. Additional work outside scope may require additional fees.

6. Refund Policy

Before script approval: full refund, no questions asked. After script approval but before visual approval: 50% refund. After visual approval: no refund, as production matches your signed-off direction. If the delivered content does not match what you approved, we will fix it or refund you in full.

7. Intellectual Property and Deliverables

The Site and its content (excluding your materials) are owned by Selliya or its licensors and are protected by intellectual property laws. You retain ownership of the materials you provide. Upon full payment, you receive full commercial rights to all deliverables — videos, ambassador images, brand guides, photographs, and all associated assets. You may use, modify, and distribute them without restriction. Pre-existing tools, templates, and third-party materials remain with their respective owners.

8. Portfolio and Credits

Unless prohibited by a written NDA, Selliya may reference your name and display excerpts or stills from the final deliverables in our portfolio and marketing after the deliverables are publicly released by you.

9. Confidentiality

You agree not to share non-public proposals, pricing, or production plans we provide except with your professional advisers and team members who need to know and are bound by confidentiality obligations.

10. Third-Party Services and Links

The Site may link to or embed third-party services (e.g., video hosting, analytics, social media). Your use of third-party services is subject to their terms and privacy policies. Selliya is not responsible for third-party services.

11. Privacy

Your use of the Site and Services is subject to our Privacy Policy. By using the Site, you consent to the collection and use of information as described in that policy.

12. Disclaimers

To the maximum extent permitted by law, the Site and Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee any specific business outcome or results from creative work.

13. Limitation of Liability

To the maximum extent permitted by law, Selliya will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the Site or Services. Our total liability for all claims will not exceed the fees paid by you for the Services in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless Selliya, its officers, directors, employees, and affiliates from claims, damages, and expenses (including legal fees) arising from: your materials or instructions; your misuse of the Site or Services; your breach of these Terms; or your violation of third-party rights.

15. Termination

We may suspend or terminate access to the Site if you violate these Terms. Termination of Site access does not automatically terminate a Service Agreement.

16. Changes to These Terms

We may update these Terms from time to time. We will post updates on the Site and, if changes are material, we may provide additional notice. Continued use after changes take effect means you accept the updated Terms.

17. Governing Law

These Terms are governed by applicable international commercial law. Any disputes will be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of the jurisdiction agreed upon by both parties.
